ROBOSPARK LABS LLC PARTICIPANT WAIVER FORM
ACKNOWLEDGEMENT
I, the undersigned, acknowledge and agree to the following terms regarding my participation (or the participation of my minor child(ren) or ward(s)) in the programs, events, classes, and activities offered by ROBOSPARK LABS LLC:
- Assumption of Risk:I understand that participation in ROBOSPARK LABS LLC’s programs involves certain inherent risks, including but not limited to accidents, physical injuries, and illnesses that may arise from physical activities, the use of equipment, or other aspects of the programs. These risks may result from my own actions, inactions, or negligence, as well as from the actions, inactions, or negligence of others, or the condition of the facilities or equipment used.
- Scope of Activities:I acknowledge that these programs may include, but are not limited to the use of robotics equipment, coding sessions, and other related activities. Specific activities may also include field trips, competitions, and other off-site events.
- No Responsibility for Loss or Damage: I understand that ROBOSPARK LABS LLC and its employees, agents, counselors, teachers, trainers, representatives, successors, and assigns assume no responsibility for any loss, damage, illness, or injury to my person or property (or that of my minor child(ren) or ward(s)) that may occur during participation in these programs.
- Photo and Video Consent: I acknowledge that ROBOSPARK LABS LLC may use photographs, videotapes, television programs, motion pictures, tape recordings, or other similar media for promotional purposes. I consent to the use of my and/or my minor child(ren)’s or ward(s)’ names and/or likenesses in such materials for advertising, trade purposes, solicitation of patronage, promotional purposes, or other similar purposes.
RELEASE
In consideration of the permission granted by ROBOSPARK LABS LLC to participate in its programs, I, on behalf of myself and/or my minor child(ren) or ward(s), hereby agree to the following:
- Waiver of Claims: I waive, release, and forever discharge ROBOSPARK LABS LLC and its employees, agents, counselors, teachers, trainers, representatives, successors, and assigns from any and all claims, demands, rights, and causes of action of whatever kind, arising from or related to my participation (or that of my minor child(ren) or ward(s)) in these programs, events, classes, or activities. This release includes claims for any loss, damage, illness, or injury to person or property, whether arising from negligence or otherwise, except in cases of gross negligence or willful, wanton, or reckless misconduct by ROBOSPARK LABS LLC.
- No Right to Inspect: I waive any and all rights to inspect or approve the photographs, videotapes, television programs, motion pictures, tape recordings, or other similar media used by ROBOSPARK LABS LLC, including any accompanying written material.
- Release for Use of Likeness: I release ROBOSPARK LABS LLC from any and all liability, claims, losses, costs, expenses, or damages related to the use of my and/or my minor child(ren)’s or ward(s)’ names and/or likenesses in promotional materials, including claims for libel, slander, invasion of privacy, and defamation.
INDEMNIFICATION
I represent and warrant to ROBOSPARK LABS LLC that I have the authority to execute this Participant Waiver Form on behalf of myself and/or my minor child(ren) or ward(s) as their parent, guardian, or next friend. In the event of any misrepresentation or breach of this warranty, or if any claim is asserted against ROBOSPARK LABS LLC arising from my or my minor child(ren)’s or ward(s)’ participation in any program, event, class, or activity, I agree to indemnify, hold harmless, and defend ROBOSPARK LABS LLC from and against any and all liability, claims, losses, costs, expenses, or damages, including legal fees, resulting from such claims.
CANCELLATION & REFUNDS POLICY
All purchases are non-refundable. I acknowledge and agree to this policy.
ACCEPTANCE
By signing below, I expressly acknowledge and agree to the terms and conditions set forth in this Participant Waiver Form.
Photo Release Form
I grant permission to Robospark Labs LLC and its employees right to produce photographs and video taken of my child, myself, and members of my family while at Robospark Labs LLC for any lawful purpose including publication, promotion, illustration, advertising, trade, or historical archive in any manner or in any medium. I hereby release Robospark Labs LLC and its legal representatives from liability for any violation or claims relating to said images or video. Furthermore, I grant permission to use the statements of my child, myself, or my family members given during an interview or evaluation with or without my name for the purpose of advertising and publicity without restriction to time limit or geographic area. I waive my right, my child’s rights, and my family’s rights to any and all compensation stemming from the use of these materials.
